These Terms of Service ("Terms") govern access to and use of PhysEdBoard, including its website, applications, educational tools, and services.
By creating an account, making a purchase, or using PhysEdBoard, you acknowledge that you have read these Terms and agree to comply with them.
PhysEdBoard's Privacy Policy supplements these Terms with respect to the processing of personal information.
1. Description of the Service
PhysEdBoard is a digital platform intended primarily for physical education and health professionals.
The platform may offer tools enabling:
- time and interval management;
- organization of groups and activities;
- use of interactive educational tools;
- educational tracking and assessment;
- creation or use of content related to teaching physical education;
- use of interactive tools for physical activities.
PhysEdBoard may add, modify, improve, replace, or remove certain features as the service evolves.
2. Eligibility
PhysEdBoard is intended for persons aged 18 or over, including teachers, education professionals, and other authorized users in an educational context.
By using the service, you represent that you are of the age required to enter into a valid contract and that you have the authority necessary to use the account created.
Students do not need to create a PhysEdBoard account for their educational information to be entered into the platform by an authorized user.
3. Account Creation and Security
Certain features require the creation of an account.
The user must:
- provide accurate and up-to-date information;
- keep their access credentials confidential;
- take reasonable measures to protect their account;
- promptly inform PhysEdBoard of any unauthorized use of their account.
An individual account is intended for the person for whom it was created.
Sharing an individual account with another person is prohibited, except where a team or institutional plan explicitly provides for multiple authorized users.
The user remains responsible for activities carried out from their account, except in situations resulting from unauthorized use for which they are not responsible.
4. Paid Access
PhysEdBoard may offer a limited free version as well as various plans providing access to additional features.
Where paid access is offered, it is acquired through a one-time payment for the access period indicated at the time of purchase.
The one-time payment is not an automatically renewing subscription.
At the end of the access period, features requiring paid access may become unavailable until the user makes a new purchase, where this option is offered.
No additional payment is automatically charged at the end of the access period.
The applicable features, access period, and price are those presented at the time of purchase.
5. Payments
Payments may be processed by a third-party payment service provider.
Where payment is processed by such a provider, PhysEdBoard does not directly retain full payment card numbers.
PhysEdBoard may retain the information necessary to manage the purchase, including access status, purchase date, access period, and transaction-related information, in accordance with its Privacy Policy.
Paid access is activated after payment is confirmed, subject to applicable technical conditions.
6. Prices
The applicable prices are those displayed at the time of purchase.
PhysEdBoard may change its prices or plans for future purchases.
A price change does not retroactively change the price of access already purchased.
Applicable taxes may be added where required by law.
7. Refunds
Purchases are generally non-refundable, except:
- where a right to a refund or cancellation is provided by law;
- in the case of a billing error;
- where a refund is expressly provided for at the time of purchase;
- where a refund is exceptionally granted by PhysEdBoard.
This provision does not limit any mandatory right granted to the user by applicable laws.
8. Acceptable Use
The user agrees to use PhysEdBoard in a lawful and reasonable manner consistent with its intended purpose.
In particular, it is prohibited to:
- attempt to gain unauthorized access to the service or to other users' accounts;
- circumvent or compromise security measures;
- engage in hacking, phishing, or any other attempt at fraudulent access;
- transmit viruses, malware, or code intended to compromise the service;
- use robots, scripts, or automated mechanisms likely to disrupt the operation of the service;
- perform security or load testing without authorization;
- reproduce, copy, resell, or redistribute the service without authorization;
- use PhysEdBoard for any illegal, fraudulent, or harmful activity;
- attempt to disrupt the availability, stability, or integrity of the platform;
- use PhysEdBoard's features or content to develop a competing service in violation of applicable rights.
9. Educational Data Entered by the User
The user remains responsible for ensuring that they are authorized to enter and process the information they submit to PhysEdBoard.
This may include:
- a student's name;
- a group or class;
- results;
- educational observations;
- information related to participation or assessment.
This information must be used only within the framework authorized by the institution, the organization, or the applicable rules.
PhysEdBoard provides educational management and tracking tools. The information entered in the platform does not necessarily constitute the institution's official school records and does not replace the official systems used by the institution.
Under a team or institutional plan, information may be accessible to users expressly authorized by the organization, depending on the available features and permissions.
10. Intellectual Property
PhysEdBoard and its elements, including the software, interfaces, tools, texts, visuals, graphic elements, logos, and the structure of the service, are protected by applicable intellectual property laws.
Unless otherwise indicated, these elements belong to PhysEdBoard or are used with the authorization of their owners.
Purchasing access grants the user a limited, non-exclusive, non-transferable, and revocable license to use the service during the purchased access period.
No ownership right in the software or elements of PhysEdBoard is transferred to the user.
11. User Content
The user remains responsible for the content and information they enter in PhysEdBoard.
They retain their rights in the content that belongs to them, subject to the rights granted to PhysEdBoard that are necessary to host, store, process, and display this content in order to provide the service.
PhysEdBoard does not use the educational information entered for the purpose of selling personal data or serving targeted advertising to students.
Personal information is processed in accordance with the Privacy Policy.
12. Availability of the Service
PhysEdBoard seeks to keep the service available and functional, but does not guarantee continuous or uninterrupted availability.
The service may be temporarily inaccessible due to:
- maintenance;
- updates;
- technical problems;
- outages at external providers;
- network or Internet problems;
- circumstances beyond our control;
- interventions necessary for the security of the service.
Where reasonably possible, planned interruptions may be communicated to users.
13. Technological Compatibility
PhysEdBoard is designed to work with compatible browsers and devices.
Operation may nevertheless vary depending on the browser, operating system, device, security settings, network, or technological environment used.
PhysEdBoard does not guarantee compatibility with all existing devices, browsers, or computing environments, including older devices or browsers that do not support certain Web technologies necessary for the operation of the service.
14. Limitation of Liability
PhysEdBoard is provided to the extent permitted by applicable law.
PhysEdBoard does not guarantee that the service will meet every particular need of each user or that it will be free of errors or interruptions.
To the extent permitted by law, PhysEdBoard cannot be held liable for indirect, incidental, or consequential damages resulting from the use of, or inability to use, the service.
In particular, PhysEdBoard cannot be held liable for problems resulting from:
- improper use of the service;
- an incompatible device or browser;
- a faulty Internet connection;
- unauthorized use of the account;
- third-party services or infrastructure;
- incorrect or incomplete information entered by the user.
Nothing in these Terms has the effect of excluding or limiting liability that cannot legally be excluded or limited.
15. Backup and Data
The user remains responsible for keeping, where necessary, their own copies of important information.
PhysEdBoard implements reasonable measures to ensure the security and availability of data, in accordance with its Privacy Policy.
However, no computing platform can guarantee that no data loss, corruption, or interruption will occur.
16. Suspension or Termination
PhysEdBoard may temporarily suspend or terminate access to an account where reasonably necessary to:
- protect the security of the platform;
- prevent fraudulent or abusive use;
- investigate a violation of these Terms;
- comply with a legal obligation;
- protect other users or the integrity of the service.
Where circumstances allow, PhysEdBoard may inform the user of the suspension or termination and the reason for it.
Suspension or termination due to a violation of these Terms does not automatically entitle the user to a refund, subject to the rights provided by law.
The end of the purchased access period ends access to the paid features associated with that period.
17. Third-Party Services
PhysEdBoard may use or integrate services provided by third parties, including for hosting, authentication, payments, technical analytics, or certain features.
These services may be subject to their own terms and policies.
PhysEdBoard is not responsible for the content, operation, or practices of third-party services that are not under its direct control.
18. Communications
PhysEdBoard may communicate with the user where necessary to:
- manage their account;
- ensure the security of the service;
- process a purchase or payment;
- provide important information about the service;
- respond to a support request;
- inform the user of an important change.
Commercial communications, when sent, comply with applicable legal requirements and the unsubscribe mechanisms they provide for.
19. Changes to the Terms
PhysEdBoard may modify these Terms in order to take into account, among other things:
- the evolution of the service;
- the addition or removal of features;
- technological changes;
- legislative or regulatory changes.
Where a significant change affects the rights or obligations of the user, PhysEdBoard may communicate the change by an appropriate means before or at the time it takes effect, as required by law.
The current version of the Terms is published on the PhysEdBoard website.
20. Governing Law
These Terms are governed by the laws applicable in Quebec and Canada.
Nothing in these Terms has the effect of depriving a consumer of a right or remedy granted by a mandatory provision of applicable law.
